Circuit Court

These sentences were recorded in January in the office of Susan M. Herrington, clerk of the Grayson County Circuit Court, Independence:

Uriel Huerta Barba, 26, guilty of possession of a firearm by a felon; sentenced to two years in jail; submit to substance abuse screening; pay $950 costs; given credit for time served.

Colt Andrew Matthews, 24, guilty of assault and battery; sentenced to one year in jail, 11 months and 20 days suspended; be on good behavior one year; pay costs; contact prohibited between defendant and victim/victim’s family or household members.

Daniel Frank Ferguson, 51, guilty of two counts of distributing schedule II drug and two counts of possession with intent to distribute schedule II drug; sentenced to 22 years in jail and fines totaling $4,000, 21 years and $3,500 are suspended; be on good behavior 21 years; submit to substance abuse screening; waive Fourth Amendment right; supervised probation for five years; pay fines and costs of $3,870; pay restitution of $348 to the Virginia State Police Drug Investigation Fund or the Grayson County Sheriff’s Department Drug Investigation Fund; operator’s license suspended 24 months; submit DNA sample; destruction of contraband held in investigation; given credit for time served.

Jesse Robert Simpson, 29, guilty of possession of controlled paraphernalia; sentenced to 12 months in jail, suspended; be on good behavior one year; operator’s license suspended six months; supervised probation for one year; pay $777 costs; given credit for time served.

Donald Smith Turnmire, 33, guilty of eluding police, reckless driving, operating a motor vehicle without permission and operating an uninsured motor vehicle; sentenced to five years and 12 months in jail and fines totaling $350, three years and 12 months are suspended; be on good behavior five years; submit to substance abuse screening; supervised probation for five years; pay $1,529 costs; given credit for time served.

Amber Nicole Hackler, 25, guilty of DWI, second offense within five years and assault and battery; sentenced to 24 months in jail and $2,50 fine, 11 months and $1,500 fine suspended; 30 day active sentence; pay $1,660 costs; operator’s license suspended three years; attend VASAP and obtain ignition interlock; given credit for time served.

Crystal Diann Proctor, 38, guilty of DWI, second offense within five years and driving without a license, third offense within 10 years; sentenced to 12 months and 30 days in jail, 12 months are suspended; home electronic monitoring for 30 days; supervised probation for 12 months; pay $1,321 costs; given credit for time served.

Terry Allen Henry, 45, guilty of making a false statement on a consent form and attempted possession of a firearm after having been a convicted felon; sentenced to six years in jail, suspended; be on good behavior six years; submit to substance abuse screening; waive Fourth Amendment right; supervised probation for three years; pay $1,875 costs; submit DNA sample; given credit for time served.

District Court

Bryan Scott Vaughan of Fries, guilty of hunt/trap/fish without a license; pay $50 fine and $88 costs.

Donald Jeremian Johnson Wilkes of Lexington, N.C., guilty of possession of marijuana; pay $250 fine and $146 costs; operator’s license suspended six months.

Andre Anthony Parris of Roanoke, guilty of no trout license; pay $50 fine and $27 costs.

Scott Allen Paxton of Vinton, guilty of hunt/trap/fish without a license; pay $50 fine and $27 costs.

Scott Allen Paxton of Vinton, guilty of no trout license; pay $50 fine and $98 costs.

Randall Scott Rhudy of Fries, guilty of obstruction of justice without force; sentenced to one year in jail, suspended; pay $201 costs.

Richard Gary Powers of Roaring Gap, N.C., guilty of DWI, first offense; pay $2,500 fine and $191 costs; operator’s license suspended one year; attend VASAP.

Thomas Leander Smith of Greenville, S.C., guilty of trespassing after forbidden; sentenced to 30 days in jail, suspended; pay $191 costs; unsupervised probation for six months.

Paula Kaye Wood of Woodlawn, guilty of possession of schedule IV drugs; pay $100 fine and $166 costs; operator’s license suspended six months.

Donnie R. Quesenberry of Hillsville, guilty of trespassing after forbidden; sentenced to one year in jail, suspended; pay $201 costs.

Charles J. Harmon of Galax, guilty of destruction of property with intent of less than $1,000; sentenced to 30 days in jail, suspended; pay $201 costs; probation for six months.

Andrew Franklin Lawson of Woodlawn, guilty of trespassing after forbidden; sentenced to 90 days in jail, suspended; pay $191 costs; unsupervised probation for one year.

Donald Ray Frazier of Austinville, guilty of excess of 50 dogs; pay $250 fine and $71 costs.

Donald Ray Frazier of Austinville, guilty of two counts of animal dealer - no care for animals; pay $100 and $110 fine and $10 costs on each.

Lanzie Carroll Horton Jr., of Hillsville, guilty of violating breeding requirements; sentenced to one year in jail, suspended; pay $500 fine and $71 costs.
