HILLSVILLE — A former Galax business owner will serve five years in prison after being convicted in June of raping a 12-year-old.
A jury in Carroll County Circuit Court had found Jimmy Ray Linville, 52, guilty in a two-day trail in March.
Galax police charged Linville after receiving a report from the female minor and her family.

Police arrested Linville at his business, Tropical Tanning Salon, in March 2012.
Linville returned to circuit court Aug. 7 for a sentencing hearing before Judge Brett Geisler.
Assistant prosecutor Mike Jones noted that the five-year prison sentence recommended by the jury would be followed, with the addition of a 40-year suspended sentence to meet state requirements.
Once Linville gets out of the Department of Corrections, he will spend the rest of his life on probation and have to register as a convicted sex offender.
Given the chance to speak, Linville still denied any guilt. He told the court he had no comments, “other than I’m just innocent — I did not do it.”
Linville is not to have any contact with the victim or the victim’s family when released from prison.
