INDEPENDENCE — A Grayson County Circuit Court grand jury has indicted a husband and wife in connection with the shooting of Grayson County Deputy Doug Waller.
Gary Frank Wheatley, 44, was indicted on one count of attempted capital murder of a law enforcement officer and one count of the use of a firearm in the commission of a felony.
His wife, Crystal Sue Gooslin-Wheatley, 47, was indicted for the attempted capital murder of a law enforcement officer – principal in the second degree. She allegedly didn’t tell the dispatcher about the gun or Wheatley’s intentions when she called police to her home.
The shooting occurred on the night of June 26 at the Wheatleys’ residence in the Fairview community just south of Galax.
Deputy Waller had been dispatched to the home on a domestic violence call.
He has recovered from the gunshot wound from a .357-caliber pistol and has since returned to work.
An indictment indicates that a grand jury found sufficient evidence for a case to go to trial, and does not indicate guilt. All of those indicted are innocent until proven guilty.
Other indictments handed down by the grand jury included:
